Welcome to Kazkar ("we," "our," or "us"), operated by Nual Ltd. These Terms of Service ("Terms") govern your use of our website and AI-powered story generation service (the "Service").

By using our Service, you agree to these Terms. If you do not agree, please do not use our Service.

1. Eligibility

You must be at least 18 years old to create an account. Kazkar is designed for children ages 2-12, but only parents or legal guardians may create accounts and manage child profiles. Children do not have direct access to the Service.

You may create up to 10 child profiles within your account. You are responsible for all activity under your account and must keep your login credentials secure.

2. Subscription and Payment

Free Plan

Our free plan includes limited monthly credits and basic features. Stories created on the free plan are shared in our public library.

Premium Plan

Premium subscriptions are billed monthly or yearly in advance. Payment is processed securely through our payment provider. All prices are in GBP (£) unless otherwise stated.

Credits and Billing

Our Service uses a credit-based system. Credits refresh monthly on your billing date and do not roll over. If payment fails, your account will be downgraded to the free plan after a grace period.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access to premium features until then.

All sales are final. We do not offer refunds after content has been generated.

3. Content Ownership and Rights

AI-Generated Content

Content generated through our Service includes stories, illustrations, and narration created by AI based on your input.

Free Plan Users

You may use generated content for personal, non-commercial purposes only. You may read stories online and print one copy for family use.

Premium Plan Users

Premium subscribers receive full commercial rights to generated content. You may publish, print, or sell your stories. Stories remain private unless you choose to share them.

Platform Rights

We may use publicly shared stories for community inspiration and marketing purposes. We do not use your content to train AI models.

4. Acceptable Use

Prohibited Content

You may not use our Service to create content that:

• Infringes Copyright or Trademarks: You may not attempt to recreate, copy, or imitate copyrighted characters, brands, or intellectual property owned by third parties. This includes but is not limited to characters from children's shows, movies, books, or other media.
• Contains violence, explicit content, or adult themes
• Promotes hate speech, discrimination, or harassment
• Is illegal, harmful, or intended to deceive
• Violates the rights of others

Your Responsibilities

You are solely responsible for ensuring that any content you create, including prompts, character descriptions, and story ideas, does not infringe on the intellectual property rights of others. You warrant that you have all necessary rights and permissions to create the content you generate through our Service.

Prohibited Activities

You may not:

• Share your account with others outside your household
• Attempt to reverse engineer our technology
• Use automated tools to access the Service
• Interfere with or disrupt the Service
• Resell or redistribute our Service

Important: We reserve the right to review, monitor, and remove any content that violates these Terms without prior notice. We may suspend or terminate accounts that repeatedly violate our policies. Removal of content or account termination does not entitle you to a refund.

5. Copyright and DMCA

Respecting Intellectual Property

We respect the intellectual property rights of others and expect our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

Copyright Infringement Notification

If you believe that content on our platform infringes your copyright, please send a written notice to contact@kazkar.com with the following information:

• Identification of the copyrighted work you claim has been infringed
• Identification of the material that is claimed to be infringing (URL or description)
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information in the notice is accurate
• Your physical or electronic signature

Counter-Notification

If your content was removed due to a copyright claim and you believe it was removed in error, you may submit a counter-notification to the same email address.

Repeat Infringers

We may terminate accounts of users who repeatedly infringe the copyrights of others.

Note: Submitting a false DMCA notice or counter-notice may result in legal liability. Consult a lawyer if you're unsure.

6. Our Intellectual Property

Kazkar, our logo, and platform technology are owned by Nual Ltd and protected by intellectual property laws. You may not copy or reproduce our platform without permission.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service is provided "as is" and "as available."

We reserve the right to modify, suspend, or discontinue features with notice. We may perform maintenance that temporarily interrupts service.

8. Account Termination

You may delete your account at any time. All your data will be permanently removed within 30 days.

We may suspend or terminate your account if you violate these Terms, engage in illegal activity, or for payment fraud. Termination results in loss of access to all content and features, with no refunds provided.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

AI Content Quality

Our Service uses artificial intelligence to generate stories and illustrations. While we strive for high quality, AI-generated content may contain:

• Minor inconsistencies in illustrations or text
• Variations in art style or character appearance
• Occasional grammatical imperfections
• Results that differ from your exact expectations

AI-generated illustrations are artistic interpretations and may not be photorealistic representations. These variations are inherent to AI technology and are not considered defects unless they substantially prevent the story from being used as intended.

Parents should review AI-generated stories before sharing with children.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUAL LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Nual Ltd from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of third-party rights, including intellectual property rights
• Content you generate or share through the Service

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before filing any legal claim, you agree to contact us to attempt informal resolution.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified via email at least 30 days in advance. Your continued use after changes take effect constitutes acceptance.
